The Fifth Amendment of the Constitution says that No Person, "Shall be deprived of Life, Liberty, or Property without due process of law.
The Prisoners at Guantánamo Bay were not tried only convicted.
International Law states that, "Anyone who is deprived of his/her liberty by arrest or detention shall be entitled to take proceeding before a court, in order that the court may decide without delay on the lawfulness of his/her detention and order his/her release if the detention is not lawful".
It has been five and a half years since the first detainees were transferred to the U.S Naval Base at Guantánamo Bay, Cuba. Despite widespread international condemnation, Hundreds more people from more than 30 nationalities remain.
Sure, There may be Al Qaeda or Taliban members at Guantánamo Bay, But how will we ever know if they are not given the rights that Every Human Being is Entitled to, A Fair Trial.
There are approximately 355 people in custody at Guantánamo Bay (as of August 15, 2007) And only 10 of these Prisoners have been charged with any crime. 1 in which was a Prisoners guilty plea.
There is no age limit to get into Guantánamo Bay, Mohammed Ismail Agha was taken into U.S. custody in Afghanistan in late 2002 before later being transferred to Guantánamo Bay at age 13 (without a trial)
These Men and Woman are tortured everyday all in hopes that they plead guilty to a crime they may not have committed. This is extremely Unhuman and completely Un-American. It is no wonder why these countries hate America. Why can't they be offered the right that any citizen of the world is entitled to and get a fair trial? Is it because the Government knows that these people are innocent and needs someone to blame for the problems in the world and in America? Perhaps a nice long look in the mirror is in order.
This certainly doesn't sound like, "Life, Liberty, and the Pursuit of Happiness at its finest.
Whether these people deserve to be at Guantánamo Bay or not, Nobody should be tortured and everybody should get a fair trial, especially in America.
